1. Definitions and Interpretation
In this agreement, the following definitions and rules of interpretation will apply, unless the context requires otherwise:
1.1 “Agency”: 15th Avenue, a trading name of 15TH AVENUE LTD, registered in England and Wales under company number 15415292, with a registered address at 142 Abbey Meadows, Unit 29, LE4 5FP, England, UK.
1.2 “Applicant”: a person introduced by the Agency to the Client either orally or in writing for potential employment or engagement in respect of childcare, housekeeping, companion, or any other job profile, on a temporary basis (including for reasons of maternity) or a permanent basis, whether full or part-time.
1.3 “Client”: any person, including any family connections of such person, or company who contacts the Agency with the aim of Engaging an Applicant and for whom the Agency has agreed to provide the Services in accordance with these Conditions.
1.4 “Contract”: the contract between the Agency and the Client for the provision of the Services incorporating these Terms and Conditions as evidenced by the signing of the Registration Form and the acceptance by the Agency in accordance with Clause 2.1.
1.5 “Data Protection Legislation”: (i) unless and until the GDPR is no longer directly applicable in the UK, the General Data Protection Regulation ((EU) 2016/679) and any national implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the UK and then (ii) any successor legislation to the GDPR or the Data Protection Act 1998.
1.6 “Engagement”: the engagement, employment or use of the Applicant by the Client or any third party on a temporary or permanent basis following an introduction by the Agency. “Engages” or “Engaged” shall be interpreted accordingly.
1.7 “Engagement Commencement Date”: in relation to an Engagement, the date on which the relevant Applicant’s Engagement with the Client commences. In the absence of other evidence, the date upon which the Applicant attends the Client’s property (or such property as the Client has directed) and starts working in any role shall be deemed to be the Engagement Commencement Date.
1.8 “Family Registration Form”: the booking form to which these Terms and Conditions are attached setting out, amongst other things, the Client’s details and requirements for a nanny, other childcare professional, Companion or domestic worker.
1.9 “Introduction”: the passing by the Agency to the Client of a Curriculum Vitae or any other information in relation to an Applicant.
1.10 “Introduction Fee”: the relevant fee payable by the Client to the Agency in accordance with Fee and Guarantee schedule.
1.11 “Introduction Fee Due Date” has the meaning given in Clause 6.1.
1.12 “Confidential Information”: all personal and business information about the Client to this agreement, including details about their family, children, business, friends or any information of a personal nature.
1.13 “Permanent Engagement”: Engagement for any period of more than 12 consecutive weeks (full-time or part-time).
1.14 “Temporary Engagement”: an Engagement for any period up to and including 12 consecutive weeks (full-time or part-time).
1.15 “Services”: an introduction service whereby a Client is introduced to one or more Applicants to work for the Client as a nanny, mother’s help, housekeeper, Companion or other childcare professional or household staff.
1.16 “Trial Day”: Before entering into an Engagement, the Client may request that an Applicant work, for one or more days to enable the Client and the Applicant to assess their mutual suitability.
1.17 “Terms and Conditions”: these terms and conditions, as amended from time to time.
1. Registration Fee:
Any Family or Company wishing to become a 15th Avenue client for the first time must complete the registration form on our website and pay an initial fee of £500. This fee is refunded exclusively if, within 90 days of the request, at least 1 suitable profile is not presented to the Client, based on the requests made in the registration form.
15th Avenue is happy to boast 90% of regular Clients who return to us to hire staff for their child, elderly loved ones and home care staff. The initial fee is asked to confirm that the Client is serious about taking the path we take with the utmost efficiency, speed, seriousness and confidentiality.
For returning clients, the search initiation fee will be £250.
The final fee will be due at the time of ‘agreement with the successful candidate, before she begins the actual work.
2. Fees for Permanent Full-Time Placements:
Fees are calculated over a period of 52 weeks.

3. Temporary Placements: Fast Track Agency Fee:
1 to 12 consecutive weeks: £130 per week (£170 during Christmas Holidays, except Christmas Day and/or New Year’s Eve Day, which are charged at £300 each day).
Please, note that the initiation fee for temporary placements is NOT refundable and will NOT be deducted from the agency placement fee.
All placement outside of the UK are charged at 24%.
4.Fast Track Agency Fee:
Please note that the Initial Fee is NOT refundable. If the Client suspends the search, he/she will have to pay another Initial Fee in order to open a new search in the future.
ADVANTAGES OF THE FAST TRACK AGENCY FEE:
5. Additional Services and Fees:
Babysitter: 100£ a day if less than 12 weeks
Tutor: 22% of the annual salary
Travel Nannies: £120 per week (UK) or £140 per week (overseas).
Maternity Nurse: £140 per week; if hired for more than 8 weeks, 24% of the total salary.
6. Cancellation Policy (Excluding Babysitters and Elderly Companions):
Cancellation fee equals 25% of the full introduction fee or two weeks’ remuneration, whichever is greater, if withdrawing an offer before the candidate accepts.
Cancellation fee equals 50% of the full introduction fee or four weeks’ remuneration, whichever is greater, if withdrawing an offer after the candidate accepts but before the agreed start date.
100% cancellation fee of the full introduction fee applies if terminating the engagement after the candidate has accepted the offer and the agreed start date.
Cancellation: A cancellation fee applies if cancelling with less than 48 hours’ notice.
7. Guarantee Extension Fee:
The guarantee period is eight weeks.
Clients may extend the guarantee period before the candidate’s start date, at a rate of 5% of the agency fee value per additional month, up to a maximum of 6 additional months.
The company reserves the right to not honor any Guarantee Extension if the invoice is not settled in full within 7 days of issuance.
These Terms and Conditions are current as of 19th March 2024. Positions that have registered by Clients with 15th Avenue prior to this date will be charged at the rates that were applicable at the time of their registration.
